These Terms & Conditions apply to all services, care plans, digital products, and website packages provided by NobleGate Studio,
By working with NobleGate Studio or purchasing any service, care plan, or digital product, you agree to the following terms.
1. Project Scope & Deliverables
Each project begins with a written proposal outlining the scope, deliverables, and timeline. Any request outside the agreed scope — including new pages, additional features, or extra design work — will be quoted separately.
If the scope changes during the project, timelines and pricing may be adjusted accordingly.
2. Communication & Collaboration
Clear communication and timely feedback are essential for maintaining project timelines. If delays occur due to late feedback, missing content, or lack of response, the project timeline may shift and may need to be rescheduled based on availability.
All communication is handled during business hours: Monday–Friday, 09:00–17:00 (CET).
All communication is handled via email unless otherwise agreed. Messages sent through social media or personal channels may not be monitored.
3. Content & Materials
You are responsible for providing accurate content, photos, and business information. If support is needed to prepare content, NobleGate Studio will guide you through the process.
You confirm that all materials you provide (text, images, logos, etc.) are owned by you or properly licensed.
4. Revisions
Each service includes a defined number of revision rounds, as stated in your proposal. Additional revisions can be added as extra services and will be quoted separately.
Revisions must be requested within the project timeline. Requests made after project completion are considered new work.
5. Payments
All projects require full payment upfront to secure your place in the schedule. This ensures dedicated time, preparation, and resources are reserved exclusively for your project.
Payments are non‑refundable once the project has begun.
Invoices must be paid by the due date. Late payments may delay the project or pause work until payment is received.
6. Ownership & Usage Rights
Upon full payment and project completion, you receive the rights to use the final approved designs for your business.
This includes:

logo
-
brand elements
-
website design
-
custom graphics created specifically for your project
Working files, drafts, and unused concepts remain the property of NobleGate Studio unless otherwise agreed.
7. Designer Rights & Portfolio Use
NobleGate Studio retains the right to showcase completed projects — including visuals, mockups, and website screenshots — in our portfolio, social media, and promotional materials.
This helps future clients understand the quality and style of our work.
8. Licensed Assets
Any fonts, stock photos, icons, or third‑party assets used in your project are subject to their respective licenses.
If additional licenses are required for your specific use, you will be informed.
9. Website Packages
Website packages include the features listed on the product page. Anything not explicitly listed is considered outside the package scope and may require an additional quote.
Packages do not include:

custom development
-
new features not included in the package
-
third‑party app fees
-
copywriting (unless stated)
-
ongoing maintenance (unless paired with a care plan)
10. Website Care Plans (Subscriptions)
Care plans provide ongoing support, updates, and maintenance after launch.
10.1 What’s Included
Each plan includes the features listed on the pricing page, such as:

small content updates
-
monitoring
-
backups
-
performance optimization
-
priority support (depending on plan)
10.2 Small Updates
Small updates include:
-
photo swaps
-
text edits
-
availability updates
-
adding new animals
-
adding show results
-
minor layout refinements
10.3 Excluded Work
The following are not included in small updates:
-
new pages
-
redesigns
-
new features
-
gallery rebuilds
-
form creation
-
booking systems
-
structural changes
-
anything requiring significant design or development time
These will be quoted separately.
10.4 Support Response Times

Essential: email support within 2–5 business days

Pro: priority support during business hours

Premium: same‑day priority response (requests submitted during business hours)
10.5 Billing & Cancellation
Care plans are billed monthly or annually. Subscriptions renew automatically until cancelled.
You may cancel at any time. Your plan remains active until the end of the paid period. No partial refunds are provided for unused time.
If a payment fails, services may be paused until payment is resolved.
11. Digital Products
Digital products (templates, guides, downloads, etc.) are delivered instantly via email or download link.
11.1 No Refunds
Due to the nature of digital goods, all sales are final. By purchasing, you agree to waive your EU right of withdrawal for digital content delivered immediately.
11.2 Licensing
Unless stated otherwise, digital products are for personal or business use only and may not be resold, shared, or redistributed.
12. Website Management & Third‑Party Services
NobleGate Studio is not responsible for outages, bugs, or issues caused by:

hosting providers
-
domain registrars
-
Wix or other platforms
-
third‑party apps
-
client‑made changes
We will assist where possible, but responsibility lies with the external provider.
13. Refunds & Cancellations
Payments are non‑refundable once work has begun. If you need to pause or reschedule, we will do our best to accommodate a new timeline.
Digital products are non‑refundable.
Care plans can be cancelled at any time but are not refunded for the remaining period.
14. Timelines
We aim to deliver projects efficiently while maintaining high‑quality design. Timelines may shift if feedback, content, or approvals are delayed.
If a project becomes inactive for more than 30 days due to missing content or feedback, it may be paused or archived. A restart fee may apply to resume the project, depending on availability.
15. Chargeback Protection Clause
Chargebacks & Payment Disputes By purchasing a service, care plan, or digital product from NobleGate Studio, you agree to contact us directly to resolve any concerns before initiating a chargeback with your bank or payment provider. Unauthorized or unfounded chargebacks will be considered a breach of contract. If a chargeback is filed without prior communication, all project work and access to deliverables may be paused until the dispute is resolved. If a chargeback is reversed in our favour, you remain responsible for any fees or losses incurred as a result of the dispute.
16. Force Majeure Clause (Belgian Standard)
Force Majeure NobleGate Studio cannot be held responsible for delays, interruptions, or failure to deliver services caused by events outside our reasonable control. This includes (but is not limited to): natural disasters, illness, accidents, power outages, fires, strikes, pandemics, government restrictions, hosting/platform outages, or any other unforeseen circumstances. In such cases, timelines may be adjusted, and both parties agree to work together to find a reasonable solution.
17. Limitation of Liability
NobleGate Studio makes every effort to provide accurate, high‑quality work, but we cannot guarantee error‑free results. NobleGate Studio is not liable for:

loss of revenue, sales, or business opportunities

business interruption
-
third‑party service failures (hosting, domains, Wix, apps, etc.)
-
issues caused by client‑provided content or materials
-
changes made by the client or third parties after project delivery
-
misuse of delivered files
-
indirect, incidental, or consequential damages
Our total liability for any claim related to our services is limited to the amount paid for the specific service in question.
18. Jurisdiction Clause (Belgian Law Applies)
Applicable Law & Jurisdiction These Terms & Conditions are governed by Belgian law. In the event of a dispute, both parties agree that the courts of the judicial district of Liège have exclusive jurisdiction.

After your project is complete, you may continue working with us through care plans or à‑la‑carte services. We are here to support your brand as it grows.
